1. General Provisions
1.1. These Terms of Use govern the use of the online store bio2you.lv, the purchase of goods, payment, delivery, withdrawal rights, returns, and the liability of the parties.
1.2. The seller operating the online store is SIA B2Y, registration No. 40103243404, VAT No. LV40103243404, registered address: “Vismaņi k-5”, Mārupe parish, Mārupe municipality, LV-2167, Latvia.
1.3. For communication regarding orders, delivery, returns, and other matters, please use the email address ecommerce@bio2you.eu and phone number 20626606.
1.4. By placing an order on bio2you.lv, the buyer confirms that they have read and agree to these Terms.
1.5. These Terms apply to the extent that they are not limited or replaced by mandatory applicable laws regarding consumer protection, distance contracts, lack of conformity of goods, and other related matters.

2. Goods, Prices, and Availability Information
2.1. All prices in the online store are indicated in euro (EUR).
2.2. Unless stated otherwise, prices include the applicable value added tax.
2.3. Information about goods, their characteristics, use, volume, composition, availability, and price is indicated next to the respective product.
2.4. We reserve the right to change prices, product assortment, promotional conditions, and availability at any time without prior notice. Such changes shall not apply to orders already confirmed and paid for before the publication of the relevant changes, unless applicable law provides otherwise.
2.5. If, after receipt of the order, it turns out that the ordered product is unavailable or objectively cannot be delivered, we will inform the buyer and agree on fulfilment, replacement, partial fulfilment, or refund of the amount paid.

3. Placing Orders and Conclusion of Contract
3.1. The buyer may place an order with or without creating a customer account.
3.2. When placing an order, the buyer must provide truthful, accurate, and complete information about themselves, the delivery address, and other data necessary for order fulfilment.
3.3. The purchase contract between the buyer and the seller is deemed concluded when the buyer has placed the order and received an order confirmation or other electronic confirmation of acceptance from the seller.
3.4. The seller has the right to refuse to fulfil the order if there are objective grounds to believe that the information provided is false, payment has not been received, the order is fraudulent, or fulfilment is impossible for reasons beyond the seller’s control.

4. Payment
4.1. Payment for the order may be made by bank card or internet banking using the payment solutions available in the online store.
4.2. The order is processed after successful receipt or confirmation of payment.
4.3. Third-party payment service providers may be used for payment processing.

5. Delivery and Receipt of Orders
5.1. Delivery is provided in Latvia, the Baltic states, and other European Union countries in accordance with the delivery methods available in the online store.
5.2. For delivery outside the European Union and the European Economic Area, the buyer must contact the seller separately in advance by email at ecommerce@bio2you.eu.
5.3. Depending on the delivery address and selected service, parcel locker delivery, courier delivery, or local pickup may be available.
5.4. Local pickup is available at: “Vismaņi k-5”, G building, Mārupe parish, Mārupe municipality.
5.5. Orders are usually dispatched on the next business day after payment is received, unless otherwise stated on the product page or during checkout.
5.6. Approximate delivery times in Latvia and the Baltics are as follows: parcel locker delivery usually 2–3 business days after dispatch, courier delivery usually 3–4 business days after dispatch.
5.7. International delivery times may vary depending on the destination and carrier.
5.8. The delivery price is indicated during checkout before payment is made. For certain delivery methods and countries, the delivery fee may vary depending on the destination, carrier tariffs, fuel surcharges, logistics costs, and the specific order parameters.
5.9. During promotional periods, free delivery from EUR 30 may apply to certain delivery methods if this is clearly indicated in the online store or during checkout.
5.10. The buyer assumes the risk of accidental loss of or damage to the goods from the moment the goods are handed over to the buyer or the person designated by the buyer, insofar as applicable law does not provide otherwise.
5.11. If the buyer fails to collect the shipment from the parcel locker or otherwise fails to ensure receipt within the time limit specified by the carrier, the shipment may be returned to the seller. In such case, the buyer shall bear the cost of re-shipment.
5.12. If the shipment is lost in transit and this is confirmed after investigation, the buyer has the right to choose a full refund, including the delivery fee, or a repeat shipment, as mutually agreed.

6. Right of Withdrawal
6.1. The consumer has the right to withdraw from the distance contract within 14 calendar days without giving any reason.
6.2. The withdrawal period shall be calculated from the day on which the consumer or a third party indicated by the consumer, other than the carrier, acquires possession of the goods. If several goods forming one order are delivered separately, the period shall be calculated from the day of receipt of the last item.
6.3. To exercise the right of withdrawal, the consumer must send the seller a clear notice of the decision to withdraw within 14 days by email to ecommerce@bio2you.eu or in another written form.
6.4. After sending the notice of withdrawal, the consumer must return the goods to the seller without undue delay and no later than within 14 days, unless the parties have agreed otherwise.
6.5. The exercise of the right of withdrawal shall be assessed in accordance with the applicable consumer protection and distance selling regulations.

7. Return Procedure and Refund Terms
7.1. In order for the return process to proceed efficiently, the buyer is advised to contact the seller before sending the goods back by email to ecommerce@bio2you.eu, indicating the order number, the returned goods, and the reason for return, if such reason is provided.
7.2. Returned goods must be handed over in a condition in which the consumer was allowed to inspect them in order to ascertain their nature, characteristics, and functioning.
7.3. The consumer is liable for any diminished value of the goods if the goods have been used more than necessary to establish their nature, characteristics, and functioning.
7.4. When returning goods, the buyer must ensure that all components, accessories, and, where applicable, instructions or other documentation supplied with the goods are also returned.
7.5. If the consumer has lawfully exercised the right of withdrawal, the seller shall refund the payments received no later than within 14 days from receipt of the withdrawal notice; however, the seller is entitled to withhold the refund until the returned goods or proof of their dispatch has been received.
7.6. The refund shall be made using the same means of payment that the consumer used for the initial transaction, unless the parties have expressly agreed otherwise.
7.7. If the consumer has chosen a delivery method more expensive than the standard delivery method offered by the seller, the seller is not obliged to reimburse the difference in cost.
7.8. The direct cost of returning the goods shall be borne by the buyer, unless applicable law provides otherwise or the seller has expressly offered more favourable conditions.

8. Exceptions to the Right of Withdrawal
8.1. The right of withdrawal may not be exercised in cases where it is excluded by applicable law.
8.2. In relation to cosmetic, body care, or other goods which are not suitable for return for health protection or hygiene reasons, the right of withdrawal may not apply if the sealed packaging has been opened after delivery or the integrity of the protective packaging has otherwise been compromised in a way that prevents the goods from being safely offered for resale.
8.3. Such exceptions shall apply only to the extent permitted by applicable law.

9. Damaged or Non-Conforming Goods
9.1. If the buyer receives damaged goods or goods that do not correspond to the order, the buyer must notify the seller as soon as possible by writing to ecommerce@bio2you.eu and, where possible, attaching photographs and the order number.
9.2. If only the outer packaging of the shipment is damaged, but the goods themselves are not damaged, this alone shall not constitute grounds for claiming a refund.
9.3. If, after assessment, it is established that the goods are damaged, non-conforming, or the damage falls within the seller’s or delivery partner’s responsibility, the seller shall provide a remedy in accordance with applicable law, including repair, replacement, price reduction, or refund, depending on the circumstances.

10. Buyer’s Obligations and Liability Regarding Use of Goods
10.1. Before using the goods, the buyer must familiarize themselves with the product description, composition, instructions for use, and warnings, if such are indicated on the packaging, product page, or other accompanying documentation.
10.2. The buyer must take into account their individual characteristics, including allergies, sensitivities, or other risks of reaction associated with the use of a specific cosmetic or body care product.
10.3. The seller shall not be liable for consequences arising where the goods have been used contrary to their intended purpose, ignoring instructions, or without evaluating individual suitability, to the extent permitted by applicable law.

11. Intellectual Property and Use of the Website
11.1. All rights to the content of the online store, including texts, design, images, graphical elements, logos, and other materials, belong to the seller or the respective rights holders.
11.2. Without prior written permission, copying, republishing, modifying, or using such content for commercial purposes is prohibited, except where permitted by law.
11.3. The buyer may not use the website unlawfully, interfere with its operation, attempt to circumvent security mechanisms, or take any other action that may cause harm to the seller, the website, or third parties.

12. Processing of Personal Data
12.1. Personal data is processed in accordance with the Privacy Policy published on bio2you.lv.
12.2. Information about cookies, analytics tools, marketing consents, and the rights of data subjects is included in the separate Privacy Policy.

13. Dispute Resolution and Applicable Law
13.1. These Terms shall be governed by the laws of the Republic of Latvia.
13.2. Any disputes between the buyer and the seller shall primarily be resolved through negotiations.
13.3. If the dispute cannot be resolved through negotiations, the consumer has the right to apply to the Consumer Rights Protection Centre or to a court in accordance with applicable law.

14. Amendments to the Terms
14.1. The seller has the right to amend these Terms of Use at any time.
14.2. The new version of the Terms shall enter into force on the date of publication unless stated otherwise in the relevant version.
14.3. Orders shall be governed by the version of the Terms that was in force at the time the order was placed, unless applicable law provides otherwise.
